Whither the Regulator: The Role of Regulators in Managing the Energy Transition

Political uncertainty and the energy transition have imposed unprecedented demands on governments to build new energy infrastructure over short time horizons. A consequence of this, at least in Canada, is the trend to increasingly centralize policy and procurement decisions in provincial governments and government agencies, and to bypass or narrow regulatory overview through government directives, legislatively scoped review processes and other mechanisms.  

Is this an inevitable implication of imperatives to build massive amounts of new infrastructure over compressed timeframes? More importantly, is this a positive or negative development?

Key Questions to be addressed: 

  1. What are appropriate roles for regulators vis-à-vis governments and government agencies in overseeing the energy transition? 
  2. What do regulators require from governments to clarify regulatory oversight and enable effective and timely regulatory review?
  3. How can and should regulatory processes be adapted to build the needed infrastructure quickly and at least cost?
